GENERAL TERMS AND CONDITIONS FOR USING THE SERVICES OF GADGETARIUM.PRO

⚠️ ATTENTION! Please read these General Terms carefully before using this website. By using this website, you are considered to have accepted and agreed to these General Terms. If you DO NOT ACCEPT these terms, do not use this website!

These GENERAL TERMS AND CONDITIONS govern the relationship between “Gadgetarium” EAD and the Users of electronic (Internet) pages and services available on the domain www.gadgetarium.pdro. They also regulate the use of informational and commercial services offered by Gadgetarium.pro (the Services) in the Online Store, including the conditions for concluding a distance sales contract with “Gadgetarium” EAD or another merchant ("Partner"), offering goods and services for sale through the Online Store.

To use the Services of Gadgetarium.pro, the User must register in the Online Store, thereby agreeing to fully accept and comply with these General Terms and Conditions.

SELLER INFORMATION

TERMS OF USE FOR THE GADGETARIUM.PRO ONLINE STORE

By registering in the Online Store, the User confirms and declares their agreement with the following:

  • The visualization of products in the Online Store acts as an online catalog displaying the Seller's product portfolio and does not constitute a legally binding offer. By clicking the "Buy Now/Buy with One Click" button, the User expresses their intention to purchase the selected item. The Seller confirms receipt of the order and processes it accordingly. Once successfully processed, the User receives a notification approving the order and initiating its delivery. If any of the cases outlined in these General Terms and Conditions apply, the Seller may decline the order and not confirm the conclusion of a distance sales contract.
  • The informational services of the Online Store are provided "as published." Gadgetarium.pro is not responsible for the accuracy of the published information.
  • Gadgetarium.pro is not liable for providing updates on completed orders, the status of customer inquiries, product availability, or for any damages, lost profits, or other financial losses resulting from the use or inability to use (due to technical issues, maintenance, administrative decisions, etc.) the Online Store. Users can track their order status in their profile or via email notifications (https://www.gadgetarium.pro/profile).
  • Gadgetarium.pro is not responsible for damages requiring equipment repair, data loss, or any other technical issues resulting from the use of the Online Store. All costs related to fixing such damages are at the User's expense.
  • For specific items, the User may request availability/status information by clicking the "Inquiry" button. In such cases, the Seller registers the inquiry, and the User receives an automatic email confirming the receipt of their request. The Seller is only committed to providing information about the availability/status of the selected item and does not guarantee the conclusion of a sales contract for such products ("Products with Inquiry Status").
  • The Online Store’s system reflects the real-time availability of items at the time of the check. However, due to inventory fluctuations, items listed as "available" in Gadgetarium stores at the time of the check may be out of stock when placing the order. Gadgetarium.pro will notify customers about the possibility/impossibility of fulfilling their order.
  • The terms of delivery/payment may be subject to change. Gadgetarium.pro will inform the User via email, phone, or other suitable means about any changes before sending the order confirmation.
  • To use the Online Store, the User must have access to the World Wide Web directly or through internet-enabled devices and provide all necessary equipment (e.g., computer, modem, or other internet connection devices). Gadgetarium.pro is not responsible for any interruptions or technical issues related to the User's computer equipment that hinder their use of the Online Store.
  • During registration, the User must provide accurate, current, and complete information required for the sales process.
  • The Seller is not responsible for incorrectly executed orders if the User provides inaccurate, outdated, or incomplete information. In such cases, the Seller has the right to restrict or deny further access to some or all of the Online Store services.
    • Users can request changes to the delivery address, payment method, invoice details, or order modifications before order processing.
    • Once the order has been confirmed and dispatched, no further changes can be made.

CONSENT FOR MARKETING COMMUNICATIONS AND DATA PROCESSING

By registering in the Online Store, the User has the option to check the box labeled "I want to receive information about promotions and new products." By doing so, the User confirms and declares the following:

  • The User grants their explicit, unconditional, and indefinite consent (until explicitly withdrawn in writing) for their personal data to be collected, stored, processed, and used by Gadgetarium.bg and/or third parties or Partners authorized by the company on a contractual or other legal basis. This consent applies to marketing and advertising purposes, market research, data analysis, and any other lawful purposes.
  • The User agrees to receive commercial communications via the contact details provided, including notifications about products and services, ongoing promotions, marketing campaigns, and market research inquiries. If the User wishes to opt out, they can unsubscribe through:
    • Inquiry forms
    • Email confirmation received after placing an order
    • The contact form available on the Online Store

By registering in the Online Store and checking the box "We need your consent to process your personal data," the User explicitly and indefinitely agrees (until explicitly withdrawn in writing) that their personal data will be collected, stored, processed, and used by Gadgetarium.pro and/or third parties authorized by the company for the purpose of using the Online Store.

By registering in the Online Store and checking the box "I accept the Terms of Use," the User confirms that they have read and agreed to the General Terms and Conditions of Gadgetarium.pro.

If the User does not check both of the mandatory fields above, registration in the Online Store will not be possible.

PERSONAL DATA PROTECTION

"Gadgetarium Bulgaria" EAD is a Data Controller established in the Republic of Bulgaria, processing personal data lawfully and in good faith for the purposes of its activities—wholesale and retail trade. The company does not process personal data in a manner incompatible with these purposes.

"Gadgetarium Bulgaria" EAD processes personal data only for the stated purposes or if the individual concerned has given their explicit consent. Without such consent, "Gadgetarium Bulgaria" EAD has no right to process personal data.

The User agrees that the personal data they provide may be transferred by Gadgetarium.pro to:

  • TBI Bank EAD if they choose the payment option "Installments with TBI Credit."
  • DSK Bank AD if they choose the payment option "Installments with DSK Bank."

The personal data provided by the User, as well as any data obtained by "Gadgetarium Bulgaria" EAD in the process of providing its services, are processed and stored in compliance with:

  • The General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679 of the European Parliament)
  • The Bulgarian Personal Data Protection Act

Detailed information about:

  • The purposes and legal grounds for processing personal data
  • The categories of recipients of personal data
  • The storage period of personal data
  • The rights of data subjects concerning their personal data
  • The contact details of the Data Protection Officer
  • Any other information required by GDPR

INTELLECTUAL PROPERTY RIGHTS AND COPYRIGHTS

Users may use all services provided by the Online Store strictly for personal, non-commercial purposes, provided that they do not infringe the copyright or intellectual property rights of Gadgetarium.pro or third parties.

  • It is strictly prohibited to copy, publicly distribute, or share materials published on this site for any purpose.
  • Gadgetarium.pro reserves the right to transfer publishing rights to third parties through a written agreement.
  • When purchasing a product protected by copyright, patent, or other intellectual property rights, Gadgetarium.pro does not grant any additional usage or distribution rights, other than those explicitly provided by the manufacturer or distributor.

All products and services offered by Gadgetarium.pro are protected under:

  • The Copyright and Related Rights Act
  • The Marks and Geographical Indications Act
  • Other applicable Bulgarian and European legislation

They are provided in their original form, packaging, and medium, without modifications, and in accordance with the licenses and distribution rights granted by manufacturers or distributors in Bulgaria.

  • Gadgetarium.pro is not responsible for the content of such websites and does not endorse or recommend their use.
  • Any risks associated with visiting these external websites are borne by the User.

PRODUCTS AND SERVICES PRESENTED IN THE ONLINE STORE

Products in the Online Store are categorized by type, group, and subgroup. Each product page contains details such as:

  • Price
  • Key characteristics
  • Availability
  • Seller information (if different from Gadgetarium)
  • Additional details to assist Users in making an informed purchase decision

Gadgetarium.pro is not liable for minor inaccuracies in product descriptions that do not affect the main characteristics of the product.

Use of Foreign Languages: Gadgetarium.pro reserves the right to list product names, models, and descriptions in English or another language if:

  • Translating the information may result in loss of essential details
  • No commonly accepted Bulgarian terminology exists
  • The product itself contains information in a foreign language (e.g., software, music, or movies)

Pricing Policy:

  • All prices are in Euro (EUR) and include VAT
  • If a product has multiple versions, the prices for each version are displayed
  • Prices are updated every hour and may differ from in-store prices
  • Gadgetarium.pro may change product details, services, and prices at any time
  • If a product is ordered with outdated information, the User will be notified before delivery

Some listed products or services may be unavailable or out of stock.

All Online Store prices apply exclusively to online purchases.

Pricing and Purchase Terms at Gadgetarium

In some cases, two prices may be displayed next to a product. One price is marked with the abbreviation "RP" (Recommended Price), which represents the recommended price in EUR, including VAT, set by the manufacturer, distributor, and/or supplier of Gadgetarium. The other price, shown in red, is the actual selling price of the product, independently determined by Gadgetarium. For user convenience, Gadgetarium displays the difference between the RP and the selling price. The purpose of this pricing visualization is to help customers make informed purchasing decisions in accordance with applicable legislation.

Gadgetarium may periodically offer selected product promotions under names such as “Electrifying Deals,” “The Big Restock,” “Tech Fever,” or others (hereinafter referred to as "Selected Offers"). These Selected Offers feature specially chosen products that Gadgetarium highlights for customers by marking them as part of the selection.

Selected Offers are designed to showcase products available in the Online Store during the promotion period. If any of the featured products are out of stock, this will be indicated accordingly, in compliance with these Terms and Conditions.

Purchasing Products and Services from the Online Store

Customers have the right to order any products and services listed in Gadgetarium.pro’s Online Store. When placing an order, customers can choose the type, brand, and model of the products, the quantity, payment method, and delivery options according to the available choices in the Online Store.

Customers may also order products that are not currently in stock at Gadgetarium stores and/or are specifically ordered from the supplier upon request ("Custom Order Products"). For such products, the estimated delivery time is displayed next to the “Add to Cart” button.

Customers can specify their preferred delivery date, which may be subject to change based on the courier’s availability for delivery to the specified address. For purchases made on installment plans, customers cannot select a specific delivery date—delivery in these cases takes between 24 hours and 4 days, starting from the moment Gadgetarium receives confirmation from the financing institution regarding the customer’s credit approval.

The products available in the Online Store are intended for personal use and are sold in quantities suitable for household consumption. If Gadgetarium.pro suspects that a customer (individual or legal entity) intends to purchase products in bulk and/or for resale and/or for non-intended use, Gadgetarium.pro reserves the right to refuse the sale at its discretion.

Before completing the order by clicking "Submit Order," the customer can modify selected items in their shopping cart. Once the order is successfully submitted, changes can be made only until the customer receives an order confirmation email. After the order is confirmed and sent for processing, no further changes are allowed.

By placing an order through the Online Store, the customer enters into a purchase contract with Gadgetarium Bulgaria EAD or its Partner (if different from Gadgetarium), as regulated by these Terms and Conditions. The contract is considered concluded upon the receipt of an order confirmation email from Gadgetarium.pro, which includes all relevant order details, following the instructions provided in the Online Store and/or in the confirmation email.

Gadgetarium.pro reserves the right to change product prices listed in the Online Store at any time without prior notice to customers. Customers must pay the price displayed at the time of placing the order, whether it is lower or higher than an updated price. If a technical error occurs in the published product information, resulting in the order being unfulfillable, Gadgetarium.pro reserves the right to cancel the order without liability beyond refunding any amounts paid by the customer.

Loyalty program cards from Gadgetarium’s partners cannot be used for purchases in the Online Store.

Delivery of Purchased Goods

The delivery time for ordered goods to the address specified by the customer is between 24 hours and 8 business days after receiving order confirmation. This period may be extended during official holidays and/or non-working days. In all cases, delays in the specified delivery times are possible, and the customer will be promptly informed by Gadgetarium.pro.

For products ordered individually, the delivery time is specified on the respective product page. The delivery period starts from the moment the order confirmation is received and may be extended during official holidays and/or non-working days. Delays in delivery are possible, and the customer will be notified accordingly.

The delivery of ordered goods is carried out according to the method chosen by the customer and within the indicated timeframes. Gadgetarium.pro reserves the right to extend the stated delivery times by up to 7 (seven) days without prior notice to customers and to extend them further with the customer’s prior consent.

Inspection Upon Delivery

Upon delivery, the customer (or an authorized representative) must carefully inspect the goods. All online store purchases include a "Check Before Payment" option, except for deliveries to Econt or Speedy parcel lockers.

If visible defects (e.g., damages, dents, or other issues) are found upon delivery, the customer must:

  1. Fill out a damage report in the presence of the courier, describing the defects.
  2. Immediately notify Gadgetarium.pro by massaging via Viber, What’sApp or Telegram +359 876 325 152.

If the customer accepts the delivery without noting any defects, all subsequent claims related to visible defects will be considered invalid.

Incorrect Address or Contact Information

Gadgetarium.pro is not responsible for failed deliveries due to incorrect or incomplete address, contact details, or phone number provided by the customer.

Upon delivery (except for installment purchases), the customer or a designated third party must sign the accompanying delivery documents. A third party is anyone who accepts the goods at the specified delivery address but is not a direct party to the sales contract.

If the customer is not present at the specified delivery address within the delivery timeframe and/or access to the location is not provided, Gadgetarium.pro is released from its delivery obligation, and the customer forfeits their right to receive the ordered goods.

If the delivered goods clearly do not match the ordered items and this discrepancy is apparent upon inspection, the customer has the right to request a replacement by immediately notifying Gadgetarium.pro via Viber, What’sApp or Telegram +359 876 325 152. If the delivery is accepted without objection, all subsequent claims will be considered invalid.

Gadgetarium.pro reserves the right to select or change the subcontractor performing the delivery without prior notice to the customer, as long as this does not affect the delivery method or timeframe.

Order Cancellation & Returns

Customers have the right to cancel a distance sales contract or off-premises contract without providing a reason and without penalty within 14 days from:

  • The date the customer or an authorized third party (excluding the courier) takes possession of the goods.
  • The date of receipt of the final item in cases where multiple goods are ordered in a single order.

If an item was not in stock at the time of order, the customer also has the right to cancel the contract under the same conditions, in accordance with the Consumer Protection Act.

To exercise the right of withdrawal, the customer must notify Gadgetarium.pro of their decision by providing:

  • Full name
  • Address
  • Order number
  • Phone number (if available)
  • Email address
  • A clear statement of their wish to cancel the contract (via mail or email).

A standard withdrawal form can be used, but it is not mandatory:

Consumer Right of Withdrawal and Returns Policy

The consumer may also complete and submit the standard withdrawal form or another clear statement of withdrawal electronically. If this option is used, Gadgetarium.pro will immediately send a confirmation of receipt of the withdrawal on a durable medium or via email.

To comply with the withdrawal period, it is sufficient for the consumer to send their message regarding the exercise of the right of withdrawal before the expiration of the withdrawal period.

If the consumer withdraws from the contract, Gadgetarium.pro will refund all payments received, including delivery costs (except for return costs, which are borne by the consumer, or additional costs related to a delivery method chosen by the consumer that is different from the cheapest standard delivery method offered by Gadgetarium.pro), without undue delay and in any case no later than 14 days from the date on which the consumer informs Gadgetarium.pro of their decision to withdraw from the contract.

By accepting these Terms and Conditions, the consumer explicitly agrees that the refund of the amount paid will be made to the bank account provided by the consumer.

Gadgetarium.pro reserves the right to withhold the refund until it has received the returned goods or until proof is provided that the goods have been sent back, whichever occurs first.

The consumer must return the goods to Gadgetarium.pro without undue delay and in any case no later than 14 days from the date on which they informed Gadgetarium.pro of their withdrawal from the contract, to one of the listed store addresses: https://gadgetarium.pro/

The deadline is considered met if the consumer sends back the goods before the 14-day period expires to one of the specified addresses.

The direct costs of returning the goods are borne by the consumer.

The goods must be returned in their original packaging, in complete condition, with all accompanying documentation, and without damage, in the same condition as they were received.

Gadgetarium.pro reserves the right to refuse to accept the returned goods if:

  • The packaging is damaged
  • There are signs of use, scratches, dents, or electrical damage
  • Accessories or the warranty card are missing

The consumer is responsible for any reduction in the value of the goods due to handling beyond what is necessary to determine their nature, characteristics, and proper functioning. Handling is considered excessive if it goes beyond what is normally required for testing in a retail store.

Withdrawal Conditions for Specific Products

The right of withdrawal for some purchased goods is subject to the Consumer Protection Act and the following conditions:

1️⃣ Printers and Multifunctional Devices

  • Must be returned with all accessories and sealed consumables (toner, ink, etc.).
  • If the consumables' packaging is unsealed, the consumer can still return the device but must pay for the unsealed consumable.

2️⃣ Laptops, Notebooks, Desktops, Monitors, and Gaming Consoles

  • Must be returned without activated passwords, profiles, or other settings that prevent resetting to factory conditions.
  • The product cannot be returned if an OEM license has been activated or if the original operating system and pre-installed software have been uninstalled.

3️⃣ Mobile Phones, Tablets, and Accessories

  • Must be returned without activated passwords, profiles, or other settings preventing factory reset.
  • The product cannot be returned if an OEM license has been activated, if the original software has been uninstalled, or if the protective film (for tablets and phones) has been removed or used.

4️⃣ Large Home Appliances

  • Refrigerators, dishwashers, ovens, microwaves, range hoods, washing machines, and similar products must be properly packaged for transport (in the same way they were delivered).

5️⃣ Air Conditioners and Air Conditioning Systems

  • Can only be returned if they have not been installed.
  • Once installed, they cannot be returned.

Products Not Eligible for Return

The right of withdrawal does not apply to the following types of contracts:

🚫 Products that deteriorate in quality due to their nature.

🚫 Sealed products that have been opened after delivery and cannot be returned due to hygiene or health protection concerns. This includes:

  • Personal care appliances (e.g., epilators, electric toothbrushes, etc.)
  • Small kitchen appliances (e.g., coffee machines, irons, vacuum cleaners)

📌 Exception: The seller may allow returns if it is proven that the item has not been opened or used.

🚫 Sealed audio, video recordings, or software that have been unsealed after delivery.

Terms and Conditions

1. Right to Change Terms Gadgetarium.pro reserves the right to unilaterally modify all delivery terms for the provided goods and any other information published on the Online store without prior notice to the Customer.

2. Communication with the Customer Gadgetarium.pro retains the right to send the Customer notifications regarding new products, services, promotions, and/or changes in delivery conditions and methods for the provided goods, as well as any other information published on the Online store, upon obtaining the Customer’s consent.

3. Territory of Application Gadgetarium.pro administers this Online store, and its application is valid solely within the territory of the Republic of Bulgaria. Gadgetarium.pro declares that the materials or services listed in this Online store are not suitable or available outside the territory of the Republic of Bulgaria, and access to them from areas outside this territory is invalid.

4. Customer Inquiries Customer questions, inquiries, and consultations can be made online via the Gadgetarium.pro Online store’s inquiry form, or by contacting via Viber, What’sApp or Telegram +359 876 325 152, during working hours: 9:00 AM to 6:00 PM, Monday to Friday.

5. Updates to Terms and Conditions These General Terms and Conditions may be updated at any time. Their publication on the Online store serves as notification to users of the changes. Before finalizing an order, the Customer is required to accept these General Terms and Conditions. By using the Gadgetarium.pro Online store, the Customer agrees to abide by these terms and the applicable legislation of the Republic of Bulgaria, as well as international law concerning the goods and services provided on the Online store.

6. Legal Provisions For any unresolved matters in these General Terms and Conditions, the provisions of the Consumer Protection Act or the Law on Digital Content and Digital Services, and Goods Sales apply.

7. Acceptance of Terms The Customer AGREES TO THE TERMS OF USE of the services provided by Gadgetarium.pro. By CLICKING on any item, link, or button on the Online store, as well as the link to these General Terms and Conditions, the Customer is deemed to be familiar with the terms and all policies of the merchant available at Gadgetarium.pro, accepts them, and agrees to abide by them.

8. Dispute Resolution In case of a dispute related to an online purchase, you may contact the relevant authorities for alternative dispute resolution (ADR) or use the online dispute resolution (ODR) platform.

Effective Date These General Terms and Conditions are effective from January 16, 2025.
